		abstract={The legal problems are how the Local Government policy on utilization
community land by transmigration program through land provisioning in Arso
District, Keerom Regency and whether thats policy already had to give a legal
protection with indemnity present for indigenous people in Arso District. The
purpose of this research is to know how the Local Government policy on
utilization community land by transmigration program through land provisioning
in Arso District, Keerom Regency and whether thats policy already had to give a
legal protection with indemnity present for indigenous people in Arso District,
Keerom Regency. The kind of research is empirical legal research. The conclusion
from results of this research are that Local Government policy on utilization
community land by transmigration program through land provisioning in Arso
District are based on Regent Decision of Jayapura The Second Degree Local
Number 59/KPTS/BUP-JP/1981 and Regent Decision of Jayapura The Second
Degree Local Number 31/KPTS/BUP-JP/1983. But, those policies not give a legal
protection yet for indigenous people because there is no indemnity but just
recognition.
