The principles of democracy or people's sovereignty (democration rechtstaat), gave birth to the contestation of elections in a Democratic manner. The research examines and analyzes the implementation of the presidential threshold which is manifestly an unusual practice and even tends to conflict with the presidential system in Indonesia. In this study, two issues will be raised, including: The thing behind the Presidential Treshold anomaly in Presidential Administration. And the Second, the fairness of poltical patai rights as electoral contestation in the system of the extent of the presidential threshold. The goal to be achieved is to build a Presidential System that is not misguided and ensures a just democracy. This research uses an analytical descriptive method with a normative juridical approach, where data and information are analyzed normatively. The results showed that the importance of commitment in straightening out the presidential system adopted by Indonesia equal rights should not let there be an imposition of parlemnter logic into the presidential system. As well as the fundamentals of determining the threshold by not eliminating the rights of minority political parties participating in elections in proposing candidates for President and Vice President in orderto ensure the pre-establishment of justice in democracy.} }
