Abstract :
Penggunaan tanah yang ditujukan untuk kepentingan umum merupakan prioritas utama yang harus segera dilaksanakan demi terselenggara dan terjaminnya kebutuhan masyarakat pada umumnya. Namun, pada praktiknya ditemukan ketidaksesuain atas hak dan kewajiban yang diterima. Seperti halnya dalam perkara yang dibahas dalam penulisan skripsi ini. Pemerintah dalam hal ini memiliki kepentingan akan penggunaan tanah tidak melaksanakan kewajibannya untuk memberikan ganti kerugian kepada Pemilik tanah yang tanahnya digunakan untuk kepentingan umum. Sehingga, Pemilik tanah yang seharusnya mendapatkan hak atas penggunaan tanah dalam perkara ini merasa dirugikan. Oleh karenanya, perbuatan yang dilakukan Pemerintah adalah bentuk Perbuatan Melawan Hukum. Atas dasar Perbuatan Melawan Hukum, Pemilik Tanah mengajukan Gugatan Perbuatan Melawan Hukum di Pengadilan Negeri Menggala. Atas gugatan tersebut, Majelis Hakim memutuskan mengabulkan gugatan Penggugat sebagian dengan verstek. Untuk itu, penulisan skripsi ini diajukan untuk mengetahui dasar diputusnya putusan majelis hakim tersebut. Metode pendekatan yang digunakan dalam penelitian ini adalah tipe judicial case study yaitu pendekatan studi kasus hukum karena suatu konflik yang tidak dapat diselesaikan oleh para pihak yang berkepentingan sehingga diselesaikan melalui putusan pengadilan. Selain itu, sumber data yang digunakan berupa bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier. Hasil penelitian ini menunjukkan bahwa pertimbangan hukum majelis hakim dalam memutus perkara ditinjau dari kesesuaian alat bukti yang dihadirkan dipersidangan berupa keterangan surat dan saksi. Selain itu, ditinjau pula dari aspek keadilan, kepastian hukum dan kemanfaatan yang dirasa dapat diterima oleh para pihak yang berperkara. Kata Kunci: Pertimbangan Hakim, Asas Keadilan, Kepastian Hukum dan Kemanfaatan The use of land for purposes is a top priority that must be implemented immediately in order to meet and guarantee the needs of society in general. However, in practice, inconsistencies are found in the rights and obligations received. As is the case in the matters discussed in writing this thesis. In this case, the government has an interest in land use and does not carry out its obligation to provide compensation to land owners whose land is used for public purposes. Therefore, the land owner who should have the right to use the land in this case feels disadvantaged. Therefore, the actions carried out by the Government are a form of Unlawful Action. On the basis of Unlawful Actions, the Land Owner filed a Lawsuit for Unlawful Actions at the Menggala District Court. Based on this lawsuit, the Panel of Judges decided to partially grant the Plaintiff's lawsuit with verstek. For this reason, this thesis is written to find out the basis for the decision of the panel of judges. The approach method used in this research is the judicial case study type, namely a legal case study approach because a conflict cannot be resolved by the interested parties so it is resolved through a court decision. Apart from that, the data sources used are primary legal materials, secondary legal materials and tertiary legal materials. The results of this research show that the legal considerations of the panel of judges in deciding cases are reviewed from the suitability of the evidence presented at trial in the form of letters and witness statements. Apart from that, it is also reviewed from the aspects of justice, legal certainty and benefits that are felt to be acceptable to the parties involved in the case.
