Abstract :
Indonesia is a country based on law (rechtsstaat) and is not a state based on power alone (machtsstaat). Thus the sound of the first point of the seven state government system are contained in the general explanation of the Law of 1945. The logical consequence of the above principle, is that everything on earth Indonesia should be governed by a set of laws and regulations. The goal is actually good, that for the realization of public order towards a prosperous society and unseen. Rape by R. Sugandi was "a man forced the woman not his wife alone for intercourse with the threat of violence, and are required to have male genitalia into the hole genitals of a woman who then issued semen. In the period of 2013-2016 year there were several cases of rape that occurred in the city of Yogyakarta, but in the process of this case Police Resort Town (POLRESTA) experiencing difficulties in terms of proof, this happens because the victims feel ashamed after knowing her case was known by his friends so that victim repeal report. Cases of rape more difficult dictated by the police is the victim who has been raped by 6-7 months ago, because of embarrassment for mencerikatan this case to the families, the victims chose not to report to the police and the secret store.
