Abstract :
This research entitled Share Divestment Obligation Regulation At Mining Sector (Mineral and Coal). The main problems in this research is how share divestment obligation law procedure at mining factor based on law which apply in Indonesia and whether share divestment obligation regulation at mining sector (mineral and coal) is appropriate as implementing instruments on Article 33 verse (3) Indonesian Republic Constitution in 1945. This research aims to acknowledge the share divestment obligation at mining sector especially knowing and understanding whether share divestment obligation regulation at mining sector (mineral and coal) is appropriate as implementing instruments on Article 33 verse (3) Indonesian Republic Constitution in 1945. Further more, this research aims to knowing and understanding specifically which law procedure done in order to implement share divestment obligation regulation at mining sector (mineral and coal).This research using normative law research method which analyze based on positive law. Writer also used books and interviewees as this research support material. The conclusion of this law research is that the share divestment obligation law procedure has not perfect yet, because it still has slit which cause contract of work holders waywardness. Besides that, share divestment obligation regulation has oriented to return the state control yet has not optimize. This thing cause share divestment obligation at mining sector (mineral and coal) only reach the level of increase in state revenue, which this thing cause by state participant inability to buy share which offer in divestment.
