Abstract :
This research is conducted for knowing the consideration of result on verdict against recidivist of narcotic dealers in Yogyakarta. Generally, recidivist is a person who has been convicted a crime concerning, and then the person commits a crime again after serving the punishment, its result the punishment which is dropped would be increasing. The problem formulation in this research is what are the considerations of the judge in the verdict against recidivist of narcotic dealers in Yogyakarta. Method of research which is used in the research is normative legal method. The source of datas which are used such as primary data as the main data, and secondary data as the supporting data. The conclusion of this research is in dropping a verdict toward recidivist, there are several factors which are considered as the base consideration of the judge, as follows; background, social, culture, and economy; professionalism; criminal law based on legality; the defendant; the demands of society; individualism of someone; apriori behaviour; emotional behavior; power of arrogance; and the moral.
