Abstract :
The present research aims to find out and study the law enforcement for the
motor vehicle drivers using cellular phones in the jurisdiction of Yogyakarta Police
Resort and the obstacles encountered the police in the law enforcement for the motor
vehicle drivers using cellular phones in the jurisdiction of Yogyakarta Police Resort.
This research is normative legal research, based on secondary data as the main
data and primer data as supporting data. Because this legal research is juridical
normative then used analysis with qualitative measures focused on the substance
with reasoning process in drawing conclusions used the deductive method which
have originated to submission of major premise in form the rule of law and
submission the minor premise tha is fact of law from both cases then drawn the
conclusion.
The results of research were: (1) The use of cellular phones while driving a
motor vehicle is included the traffic violation. As for the law enforcement to the
motor vehicle drivers using cellular phones is directly handled by the officers, but the
officers did not receive the fine of violators. The subject are obligated to attend a
session in court or pay a session of costs court in Bank BRI. As for who has
obligation to carry out the law enforcement against the traffic violations for motor
vehicle drivers who use cellular phones in the Polresta Yogyakarta is the Traffic
Police Force of Polresta Yogyakarta. (2) The obstacles encountered by the police in
doing the law enforcement for motor vehicle drivers using cellular phones in the
jurisdiction of Yogyakarta Police Resort is the lack of public awareness of the road
users of dangers to use cellular phones while driving. The Government Regulation
supported the Law No. 22, 2009 on Traffic and Transportation has not been there,
and too dark window film on cars will complicate the police in enforcement because
the user does not admit it. To overcome the obstacles mentioned above, the police
have been making efforts to provide socialization to the community that using cellular
phones while driving is extremely dangerous act, the police have also proposed to the
government to make government regulation supported the Law No. 22 of 2009 that
the police had no difficulty in prosecuting the traffic violations people. Concerning
too dark window film on cars, the police had instructed the vehicle owner to replace
too dark windshield.
