Abstract :
This research is conducted with the objective ?Bad Credit Settlement with Authorized Private Attorney due to Insurance Object on Micro Scale Credit Agreement? in respect to Unit Mikro Mandiri Bumiayu who assign authorized private attorney at the beginning of credit agreement to advance any common issues of bad credit. This research mainly discusses about possible efforts of the bank in order to advance it?s bad credit issue with authorized private attorney due to insurance object in case of micro scale credit agreement. Empirical approach becomes the major method to obtain conclusion for this research, therefore primary data is needed as core data source and also secondary data is needed as supporting data source. Those data surely analyzed quantitatively by using inductive method of thinking. Based on data collected, the result shows that Unit Mikro Mandiri always prioritize to tread the diplomatic way as a settlement for bad credit issue instead the execution way. Assistance of authorized private attorney at the beginning of credit agreement discords public order fundamental, thereby it shall be canceled due to the respect of the law. For suggestions, Unit Mikro Mandiri Bumiayu should immediately terminate the terms of authorized private attorney at the beginning of credit agreement. As the opposite, it would be better consideration to keep prioritizing guarantee of the security rights and fiduciary insurance with an eye to every sides are receive both protection and legal certainty.
