Abstract :
Schizophrenia suffering people is called a lunatic or a person mentally deranged. People with schizophrenia often have a laughingstock or public scorn, even though they are experiencing serious psychiatric problems. Even the PWS is deliberately ignored by both the family and by the government and society in general. Domestic Violence is often identified with physical violence only, but keep in mind that limits understanding of domestic violence are contained in Article 1 Paragraph 1 of Law No. 23 in 2004 of Indonesian Law, was: "Every act of someone, especially women, resulting in misery, or suffering physical, sexual, psychological and / or negligence of household including threat to commit acts, coercion, or deprivation of liberty unlawfully within the scope of home ladder. This research aims at studying in depth the phenomenon of neglect of family members with schizophrenia, the authors undertook the writing of the law with the title: "Legal Protection Against Family Members With Schizophrenia Who Experiencing Neglect" and knowing the efforts both penal and non-penal effort associated with providing legal protection against family members with schizophrenia who experience neglect. This research is a normative legal research, is research conducted on the basis of secondary data. The results show that Article 49 a of Indonesian Law Number 23 Year 2004 on Elimination of Domestic Violence can be applied as an effort Penal in providing legal protection for family members with schizophrenia who experience neglect. While the non-penal measures in providing legal protection for family members with schizophrenia who experience neglect can be traced in the various legislations in force. As a suggestion in this study are expected to socialize the government to the general public about the Act on the Elimination of Domestic Violence and other laws and regulations relating, among others; Act No. 3 of 1966 on Mental Health, Indonesian Law No. 36 of 209 of Health, Minister of Health Decree No. 135 Year 1978 regarding Organization and Working Procedure of the Mental Hospital, the Minister of Home Affairs letter No. PEM.29/6/15, dated 11 November 1977, Decree of the Governor of Yogyakarta Special Region No. 2 / TIM/2003. So that people can observe and understand the treatment and care if they have families who suffer from schizophrenia are not neglected, but it gives a good treatment and care.
