Abstract :
The purpose of the research is studying the desertion of criminal act that is done by Indonesia National Army(TNI) and its prevention efforts using normative method supported by empirical method UU No.31 year of 1997 about Law Code of Military Tribunal and KUHPT as the reference in this thesis writing process. The desertion criminal done by Indonesia National Army (TNI) stated in KUHPT section 87 ?Go with the purpose of withdrawing self forever from the duty obligation, avoiding the danger of war, defecting the enemy or not having the army duty to other country or domination. So that it can seen how the organization way or process in order to prevent a violating done by the TNI members through the steps of investigating, demanding, and judicial proceeding that are done by ANKUM, ODMIL, Military Court, and the degree of Military Court: Military Court, High Military Court, Superiority Military Court, and Battle Military Court. By the prevailing of Law Regulation, it is intended to minimize the desertion criminal occurred that is done by Indonesia National Army (TNI).
