Abstract :
Trafficing refers to the recruitment, transport, fencing, shipment, moving or accepting individual
under the threat of violence, kidnappling, confinement, fraud,victimization, power abuse or
susceptible position, load trapping or payment granting thus one gain the agreement from those
who have power upon other people, done either within the country or between countries for
exploiting or leading to exploitation on the individuals. The aim of the research is to find the data
to identify the role of KPAI and the obstacles encountered by KPAI in giving the law protection
and the recovery for the victim of trafficing. Gaining the complete and accurate data, the
research used the normative law research, involving the secondary data as the main data taken
from the literature.
The result indicated that the Indonesian Children Protection Commision, in giving the law
protection and recovery for the victims of trafficing, took the steps as follows: Saving the victim,
providing the law assisstance for the victim, trying to provide the compensation for the victim,
rehabilitating for curing the trauma experienced by the victim, and returning the victim to her/his
family. The obstacles encountered by KPAI in giving the law protection and recovery for the
victims of trafficing included: lack of the reinforcement and the encouragement of the officers in
imposing the punishment for the criminals, the threat and intimidation from the respondent in
doing their job, lack of fund for socialization, provision of law protection and law assistance for
the victims, malfunction in monitoring between KPAI and Labour Department, Social Agency
and Non-Goverment Institution.
