Abstract :
The tittle of this research is criminal responsibility of traffic accident in the case conducted by children who cause the victim died. The background of the problems are increasing number of vehicles also caused problems, one of them is the use of a vehicle by children without having driving license can inflict traffic accidents until the victim died. The problem statements in this law research are what decisions is given by a judge against children under age who drives a vehicle until the victim died? and what consideration are given by a judge to decide in cases of children involved in traffic accidents until causing dead victim? This law research is using normative method which focus on positive law norm. The verdict who given by a judge is conditional criminal with the consideration are children are still under 18 years of age, children who are still school, background of the family, and the given compensation from the parents of defendant to the heir with the agreement.
