Abstract :
Domestic violence is a problem that is very typical because domestic
violence happens in all walks of life ranging from the low social status to people
of high social status. Most of the victims of domestic violence are women, whether
wives or daughters and the husband is usually the culprit. Advocates in the
judicial process is required by the victim, because victims have the right to be
protected and defended at the time of the judicial process takes place. The
research objective of this study is to investigate and examine the role of lawyers in
providing legal protection for wives who are victims of domestic violence in the
city of Yogyakarta.
This type of study is a normative legal research, the type of research that
focuses on secondary data (material law) as the primary data, which consists of
primary legal materials (legal norms) and secondary legal materials (legal
opinion). Analytical methods that I use for this normative legal research is to use
a method of qualitative analysis, by comparing the legal opinion that the one with
the legal opinion of others, such as looking for similarities and differences of
opinion exist. The process of reasoning used in drawing conclusions is to use the
method of deductive thinking. The procedure is a procedure reasoning deductive
reasoning derived from statements of a general nature which will then draw
conclusions of a special nature.
The resuls conclude that the role of lawyers in providing legal protection
wives victims of domestic violence is done by providing health services and
assistance to the victims of violence in the home, and seeking legal services and
medical data for purposes of the law and providing security to the victim.
Constraints faced by lawyers in providing legal protection wives domestic
violence victims, among others, there is a negative perception of society towards
the role of lawyers in carrying out the function of mentoring and advocacy, lack
of flexibility in mentoring.
