Abstract :
In Article 15 Paragraph (1) of Law No. 24 of 2011 about the Social Security Agency provides that employers and employees are required to enroll in stages in accordance with the Employment of BPJS social security which has followed. By rule expressly provided that employers and employees are required to enroll in accordance with the Employment of BPJS social security that has followed, but in reality there are many employers and employees who do not enroll in the social security, such as the Children's Home Furniture Industry Yogyakarta. The Children's Furniture Company Yogyakarta replaces the existing accident insurance in Employment of BPJS with guarantees which provided directly by the employer. While conducting this legal research, this type of research that is used is empirical legal research, which is a study that focuses on the behavior of the legal community. This research was accomplished directly to the respondents as the major data that is supported by secondary data consisting of primary legal materials and secondary legal materials. Based on the analysis and the data that obtained, it can be concluded that the factors causing the owner of. Furniture Children of Yogyakarta does not include the workers into the labor insurance program of BPJS due to the following factors: first reason is that workers are not willing to cut the salary to pay dues for BPJS Employment guarantee program. Second, because of the complicated of bureaucracy causes employers are reluctant to enroll their workers in BPJS Employment program. Third, the number of workers who are very limited makes the employers decide to take full responsibility for social security, especially in work accident insurance. All workers who injured at work, all the fee will be paid by the employers. The last factor is because the premium or fee relatively high lead workers do not want to be enrolled in insurance programs BPJS Employment.
