Abstract :
The title of this minithesis is "The influence of Constitution Court Judgement Number 5/PUU-V/2007 concerning independent candidate for growth of democracy in Indonesia". The research aim to know about the ifluence of the Constitution Court Judgement which is concerning about independent candidate for growth of democracy in Indonesia. The research method in this minithesis is normative method, which mean a research that focusing on studying the norms of law that in force (law in the book). This research indicate that Constitution Court Judgement Number 5/PUU-V/2007 concerning independent candidate is forming growth of democracy in Indonesia, because it has given the equal right to all citizens to use their political rights guaranteed by Republic of Indonesia Base Act 1945, that is equal right before the law and governance as arranged in Article 27 paragraph (1) and Article 28D paragraph (1) and paragraph (3). Therefore, government has to make regulation able to accomodate the independent candidate in implementation of election of regional leader in Indonesia
