Abstract :
Children are an integral part of human survival and sustainability of a country. If a child has committed a crime it will be processed in accordance with the laws and regulations and regulations that apply to children. The judge in this case has a very important role in the return of the child to the parent. This type of research in the writing of this law is a normative law. Source of data used in this normative legal research is secondary data, the data obtained from the material - material law library materials include primary, secondary law and tertiary legal materials. Consideration of the judge in determining the form of returning the child to the parents of children who commit crimes with criminal penalties punishable by imprisonment under the threat of 7 years and not a repetition of the crime, seen also from his family background, the nature of the criminal offense committed, in the interest of the child alone and how many times the child committed a crime. Needs re-examination by the judge of the considerations in determining the return of the child to the parent.
