Abstract :
The background of this research is ?Everyone has the right to obtain health service. Hospital as a health sevice has responsibility for providing services to everyone. There are some hospitals that refuse patients for various reasons that are not clear?. With the formulation of the problem as follows : how is the form of criminal liability for the private hospital which compound the recruitment of patients. The research method by means of : this research is normative legal, source of data in this study consist of data and primary data, research studies focus on the provisions of the applicable legislation. Criminal Liability of Hospitals in the relief of patients regulated in law No. 36 of 2009 on health. The conclution that Hospitals in accepting the patients to provide relief to the prospective patients should attach a great importance to safety of life of patients in advance, rather than concerned with the cost of the Hospitals. Hospitals which more concerned with the cost and benefits without prioritize patients?lives or even refuse patients in need of medical care may be liable in accordance with the legislation in force.
