Abstract :
The title of this research is ?THE INFLUENCE OF GENERAL AGREEMENT ON TRADE IN SERVICES (GATS) TO THE EMPLOYMENT SECTOR IN INDONESIA?. The purpose of this research is to understand how the arrangement and implementation of the employment sector in Indonesia under GATS provision, especially about liberalization and free trade. This research is inclusive of normative judicial research which is focused on positive law. The implementation of liberalization and free trade are contradict with the national law of Indonesia which is based on Pancasila (The Five Principles) and The Constitution of Indonesia, both of them are based on sosialism system of Indonesia. WTO is an international trade organization which is have a purpose to implement a liberalization and free trade in whole trade sectors, such as goods, services, investments, and intelectual properties rights. And GATS is an instrument to fulfill the purpose of WTO, especially on services sector. The employment sector include to the service sector, and GATS regulate through mode 4 GATS Presence of Natural Persons. This provision let the persons to move to another country in all measures related to the service sectors. This research focused in implementation of mode 4 GATS wich is liberalize the employment sector, and this is contradict with the provision of Indonesia labor law. On the provision of Indonesia labor law, the state have a responsibility to provide the employment for a whole peoples. This industrial relation in Indonesia called Hubungan Industrial Pancasila (Pancasila Industrial Relationship). So, this research have a purpose to give a suggestion to prepare the employment sector before the implementation of liberalization and free trade, and to protect the employees and all the peoples towards to prosperity.
