Abstract :
Customary rights is a series of authorities and obligations of a customary
law community, which relates to land located within its territory. Ulayat rights are
the main support for the livelihoods and lives of the people concerned throughout
the ages. This study aims to describe the position of customary rights of
indigenous peoples in Indonesia and the concept of legal protection for holders of
customary rights of indigenous peoples. This research is a normative legal
research that examines legislation and books related to research problems, using
qualitative research methods, a research procedure that produces descriptive data
in the form of written words. Ulayat rights as a technical juridical term are rights
that are inherent as special competencies in customary law communities, in the
form of authority/power to manage and regulate the land in its contents with
internal and external marketability. The most important progress in recognizing
ulayat rights in the Constitution in Indonesia is found in the 1945 Constitution of
the Republic of Indonesia. Article 18B paragraph 1 and paragraph 2 of the 1945
Constitution of the Republic of Indonesia. The position of ulayat rights in the
UUPA is determined in Article 3, namely By considering the provisions in
Articles 1 and 2 the implementation of ulayat rights and similar rights of
customary law communities, as long as in reality they still exist. The provisions
on legal protection of the rights of indigenous peoples to land and natural
resources in Indonesia are closely related to the provisions of Article 18 B
paragraph (2) of the 1945 Constitution of the Republic of Indonesia. These
provisions provide a constitutional position for indigenous peoples in relation to
the state and constitutional basis for state administrators, how should customary
law communities be treated. The affirmation of the legal protection of the
collective rights of Indigenous Peoples over their customary lands is more clearly
regulated in the United Nations Declaration on the recognition and protection of
the Rights of Indigenous Peoples.
