Abstract :
Permasalahan dalam penelitian ini ialah bagaimanakah fungsi visum et repertum pada tahap penyidikan dalam mengungkap suatu tindak pidana perkosaan dan upaya yang dilakukan penyidik apabila hasil visum et repertum tidak sepenuhnya mencantumkan keterangan tentang tanda kekerasan pada diri korban perkosaan. Penelitian ini merupakan penelitian hukum normatif dan bersifat deskripitif kualitatif. Fungsi visum et repertum dalam membantu penyidik mengungkap tindak pidana perkosaan adalah untuk dapat memberi petunjuk mengenai adanya unsur persetubuhan dan unsur kekerasan, perkiraan waktu terjadinya tindak pidana perkosaan, juga dapat memberikan hasil pemeriksaan terhadap barang bukti dalam tindak pidana perkosaan; dapat menjadi bukti permulaan bagi penyidik untuk melakukan penindakan lainnya dalam mengungkap suatu kasus tindak pidana perkosaan; untuk kelengkapan/kesempurnaan berkas perkara tindak pidana perkosaan yang dibuat dan diserahkan penyidik kepada penuntut umum. Visum et repertum tidak sepenuhnya mencantumkan keterangan mengenai tanda kekerasan pada diri korban, maka akan dilakukan upaya/tindakan oleh penyidik untuk menemukan dan membuktikan adanya unsur tersebut atau unsur ancaman kekerasan. The problem in this study is how the function of the visum et repertum at the investigation stage in uncovering a crime of rape and the efforts made by investigators if the results of the visum et repertum do not fully include information about signs of violence in rape victims. This research is a normative legal research and is descriptive qualitative.The function of visum et repertum in assisting investigators in uncovering the crime of rape is to be able to provide instructions regarding the presence of elements of sexual intercourse and elements of violence, the estimated time of the occurrence of the crime of rape, can also provide results of examination of evidence in the crime of rape; can be the initial evidence for investigators to take other actions in uncovering a case of a rape crime; for the completeness/completeness of the case file for the crime of rape which is made and submitted by the investigator to the public prosecutor. Visum et repertum does not fully include information regarding the signs of violence against the victim, so that investigators will make efforts/actions to find and prove the existence of these elements or elements of threats of violence.
