Abstract :
Dalam kehidupan obat- obatan memiliki peranan yang sangat berarti untuk manusia. Kedudukan obat- obatan merupakan buat mempertahankan kelangsungan hidup, melindungi serta melindungi kesehatan. Hingga dari itu keamanan obat sangat butuh dicermati oleh warga. Kebutuhan obat- obatan tiap orang berbeda- beda. Tingkatan mengkonsumsi obat- obatan warga di Indonesia produk yang ditawarkan oleh merek- merek ternama jadi kesempatan pelaku usaha tersebut melaksanakan bermacam berbagai metode supaya produk yang dia jual bisa dipasarkan dengan harga murah tanpa memandang aspek keamanan dari produk tersebut semacam izin edar dari BPOM. Penelitian ini difokuskan pada dua rumusan masalah, ialah Bentuk Pertanggungjawaban Dari Pelaku Usaha Atas Beredarnya Obat- obatan Ilegal dan Perlindungan Hukum Untuk Konsumen atas Peredaran Obat- obatan Ilegal Menurut Undang- Undang Nomor. 8 Tahun 1999 Tentang Perlindungan Konsumen. Penelitian ini memakai jenis penelitian normatif. Sumber informasi yang didapatkan merupakan informasi primer ialah bahan- bahan yang memiliki kekuatan hukum yang mengikat serta informasi sekunder yang diperoleh lewat buku- buku, jurnal, internet, artikel dan bahan hukum yang lain yang berkaitan dengan penelitian ini Dari penelitian ini diperoleh hasil kalau Pelaku usaha bertanggung jawab selayaknya pembuat benda tersebut sebab yang melaksanakan impor benda tersebut tidaklah agen ataupun importir resmi. Hingga pelaku usaha yang ialah orang perseorangan wajib bertanggung jawab atas kerugian yang ditimbulkan meski cuma selaku importir bukan selaku produsen benda tersebut. Terpaut dengan pelanggaran pasal 8 ayat 1 huruf a, d, e serta pasal 8 ayat (3). Berdasarkan pada pasal 19 ayat 1 UUPK pelaku usaha bertanggung jawab memberikan ganti rugi atas kerusakan, pencemaran, serta ataupun kerugian konsumen akibat komsumsi benda serta ataupun jasa yang dihasilkan ataupun diperdagangkan. Serta upaya perlindungan untuk konsumen yang dibuat pemerintah ialah diatur dalam pasal 8 ayat( 1) huruf a, d, e serta juga pasal 8 ayat( 3) Undang- Undang No 8 Tahun 1999 tentang Perlindungan Konsumen. In the life of medicine has a very meaningful role for humans. The position of medicine is the manufacture of sustaining life, protecting and protecting health. Until then, safety drugs really need to be observed by residents. Everyone's medication needs are different. The level of consuming drugs by citizens in Indonesia, products offered by well-known brands, is an opportunity for these business actors to carry out various methods so that the products they sell can be marketed at low prices regardless of the safety aspect of the product, such as a distribution permit from BPOM. This research is about two problem formulations, namely finding the form of accountability from business actors for the circulation of illegal drugs and legal protection for consumers for the circulation of illegal drugs according to Law No. 8 of 1999 concerning Consumer Protection. This research uses the type of normative research. The source of information obtained is primary information, namely materials that have binding legal force and secondary information obtained through books, journals, internet, articles and legal materials related to this research. From this research, it is found that the business actor is responsible as the maker of the object because he carries out the object, either an agent or an official importer. business actor who is the person who is obliged to be responsible for the losses caused even though only as an importer not as a producer of the object. It is related to the violation of Article 8 paragraph 1 letters a, d, e and Article 8 paragraph (3). Based on article 19 paragraph 1 of the UUPK, business actors are responsible for providing compensation for damage, pollution, and or consumer losses due to the consumption of goods and or services produced. As well as consumer protection measures made by the government are regulated in Article 8 paragraph (1) letters a, d, e and Article 8 paragraph (3) of Law No. 8 of 1999 concerning Consumer Protection.
