Abstract :
ABSTRACT
In the research entitled "Legal Protection of Under-five Children from Less Lucky (Toddlers Social) Fostered Children's Prosperous Park-(TAS) Satoe Village, Tarakan City, North Kalimantan" aims to be a place of shelter and care for toddlers who experience social problems such as Malnutrition, Victims Domestic violence, child neglect, disability, and poverty aged 0-5 years who are entitled to social assistance and assistance. The distribution of social assistance is needed to relieve and assist people with various deteriorating conditions in meeting their daily needs. So that the function and role of TAS is to care for, care for, educate, and supervise their children because parents have neglected their responsibility to spend their time due to work factors.
The research method used in this thesis uses an empirical method which is carried out directly and thoroughly (observation). This research uses descriptive research and qualitative methods in the form of data collection from interviews, photo/video recording data, notes and library research.
Based on the last chapter in this thesis, it can be concluded that First: The handling procedure is carried out by checking and collecting data (assessment) to find out the social identity of the toddler, name, age of the toddler, location of residence, history of illness, work background of the person parents, and supporting files for birth certificates and family cards which are intended as requirements for prospective social toddlers assisted by TAS-Kampung Satoe. This treatment aims as a form of concern for people who are experiencing a downturn in order to avoid unlawful acts, violence, neglect and discrimination. Second: Forms of legal protection for children under five when associated with Law number 23 of 2002 concerning Child Protection must provide solutions and clarity for perpetrators as parents who have committed acts of domestic violence and neglect of their children must be subject to applicable sanctions/penalties. The process of imposing sanctions and punishments goes through the stages of the Diversion/Mediation process. During the trial process, Victims and Perpetrators must carry out Rehabilitation from the causes of problems that result in compensation for physical, psychological, social, economic and mental disorders (trauma). Thoose a justice is needed (Restorative Justice).
