Abstract :
ABSTRAK Pengawasan ASN dilakukan oleh Komisi Aparatur Sipil Negara, sebagaimana dijelaskan dalam Undang-Undang Nomor 5 Tahun 2014 Tentang ASN yang telah dicabut dengan Undang-Undang Nomor 20 Tahun 2023 Tentang Aparatur Sipil Negara. Akan tetapi dalam undang-undang terbaru tidak disebutkan dengan jelas tugas dan fungsi KASN sehingga menimbulkan ketidakpastian terhadap kedudukan hukum KASN. Tujuan penelitian ini untuk menganalisis bagaimana kepastian hukum terkait tugas dan fungsi Komisi Aparatur Sipil Negara pasca disahkannya Undang-Undang Nomor 20 Tahun 2023 serta bagaimana pandangan siyasah dusturiyah terhadap permasalahan tersebut. Jenis penelitian ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan (Statute Approach) dan Pendekatan Konseptual (Conceptual Approach). Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer seperti peraturan perundang-undangan, bahan hukum sekunder seperti artikel dan buku, serta bahan hukum tersier. Hasil penelitian ini menunjukkan bahwa : 1) Undang-Undang Nomor 20 Tahun 2023 tidak menyebutkan tugas dan fungsi KASN dikarenakan akan dibentuknya peraturan pelaksana. Namun sampai saat ini belum terdapat peraturan pelaksana yang mengatur terkait tugas dan fungsi KASN tersebut sehingga kedudukan hukum Komisi Aparatur Sipil Negara tidak tampak secara jelas atau tidak ada status yang ajeg dalam pemerintahan. 2) Kepastian hukum terkait tugas dan fungsi KASN dalam Undang-Undang Nomor 20 Tahun 2023 ini tidak sejalan dengan siyasah dusturiyah yang diusung oleh Al-Mawardi, karena KASN sebagai lembaga yang berperan dalam menjaga kualitas dan profesionalisme ASN tidak memiliki kejelasan rincian tugas untuk menjalankan fungsinya secara efektif guna mewujudkan kemaslahatan. ABSTRACT ASN supervision is carried out by the State Civil Apparatus Commission, as described in Law Number 5 of 2014 concerning ASN which has been revoked by Law Number 20 of 2023 concerning the State Civil Apparatus. However, the latest law does not clearly state the duties and functions of KASN, causing uncertainty about the legal position of KASN. The purpose of this study is to analyze how legal certainty related to the duties and functions of the State Civil Apparatus Commission after the enactment of Law Number 20 of 2023 and how siyasah dusturiyah views on these issues. This type of research is normative juridical using a statutory approach and conceptual approach. The legal materials used in this research are primary legal materials such as legislation, secondary legal materials such as articles and books, and tertiary legal materials. The results of this study show that: 1) Law No. 20 of 2023 does not mention the duties and functions of KASN due to the establishment of implementing regulations.
