Abstract :
E-commerce adalah konsep yang menjelaskan proses pembelian dan
penjualan dari suatu produk barang, jasa, informasi melalui jaringan komputer
yang melingkupi internet. Dalam e-commerce perjanjian dibuat menggunakan
media elektronik yang berisi form atau blanko.Namun, dalam perjanjiansering
terjadi permasalahan wanprestasi diantara para pihak. Penelitian dengan judul
?Aspek Perjanjian Jual Beli Online (E-commerce) Apabila Terjadi Wanprestasi?
memiliki rumusan masalah bagaimana bentuk perjanjian dalam jual beli online (ecommerce)
dan bagaimana akibat hukumnya apabila terjadi wanprestasi dalam
perjanjian jual beli online (e-commerce) serta solusinya. Tujuan penelitian ini
adalah untuk mengetahui bentuk perjanjian dalam jual beli online (e-commerce)
dan mengetahui akibat hukumnya apabila terjadi wanprestasi dalam perjanjiann
jual beli online (e-commerce) serta solusinya.
Penelitian ini menggunakan pendekatan yuridis normatif. Sumber data
yang digunakan adalah data sekunder yang diperoleh dengan jalan mengumpulkan
data yang terdapat dalam buku-buku, jurnal, media elektronik dan peraturan
perundang-undangan yang berkaitan dengan permasalahan yang ada. Kemudian
data tersebut dipelajari dan dianalisis yang kemudian disebut sebagai bahan
hukum. Data yang telah diperoleh tersebut selanjutnya dianalisis.
Berdasarkan hasil penelitian dan analisis data yang diperoleh disimpulkan
bahwa bentuk-bentuk perjanjian dalam jual beli online (e-commerce) yaitu
perjanjian melalui e-mail, perjanjian melalui website dan perjanjian melalui
chatting dan video conference. Akibat hukum apabila kreditur melakukan
wanprestasi yaitu mengganti kerugian kepada debitur. Sedangkan, solusi apabila
terjadi sengketa yaitu diselesaikan dengan jalur litigasi dan non litigasi.

E-commerce is a concept that defines buying and selling process of a
product, service, and information through computer network that includes
internet. In e-commerce, the agreement is made by electronic media consisting
forms or blanks. However, in an agreement, defaults are often occurred between
the parties involved. In the research entitled ?Aspects of Online Buying and
Selling (E-commerce) Agreement if there is a Default?, the problem statements
are; how are the forms of agreement in online buying and selling (e-commerce)
and how are the legal impacts if there is a default in online buying and selling (ecommerce)
agreement as well as the solutions. This research aims to find out the
forms of agreement in online buying and selling (e-commerce) and the legal
impacts if there is a default in online buying and selling (e-commerce) agreement
as well as the solutions.
This research used normative juridical approach. The source of data used
for this research was secondary data obtained by collecting data from books,
journals, electronic media and laws and regulations related to the problems. The
data was then studied and analyzed and called by legal material. The collected
data was eventually analyzed.
Based on the results of research and collected data analysis it can be
concluded that the forms of agreement in online buying and selling (e-commerce)
were agreement via e-mail, agreement via website, and agreement via chatting and
video conference. The legal impact if a creditor made a default was by
compensating to the debitor. While the solution if there was a dispute was solved
by using litigation or non-litigation process.
