Abstract :
Diversion is the transfer of the settlement of cases of child crimes from the criminal justice process to the outside criminal justice process. The existence of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System which regulates diversion is very helpful for the Public Prosecutor in resolving cases of children in conflict with the law and preventing children from negative stigma and deprivation of independence. The main problem in this study is how to implement diversion against children as perpetrators of hate speech crimes at the prosecution stage, and what are the obstacles in implementing diversion against children as perpetrators of hate speech crimes on Facebook at the prosecution stage at the Kampar District Attorney. The research method in this research is sociological research, while the nature of this research is descriptive-analytical. while the data sources used are primary, secondary and tertiary data. Data was collected by interview and literature study. The results of the research that the author did note that the implementation of diversion against children who were perpetrators of the crime of hate speech on Facebook at the Kampar State Prosecutor's Office carried out by the Public Prosecutor was carried out based on the provisions of the applicable law and in the implementation of diversion there were not too many obstacles. After all the diversion requirements are complete and the diversion has been successfully implemented, the public prosecutor will notify the District Court that the diversion was successful in order to obtain a letter of determination from the District Court.
