Abstract :
Penyelenggaraan jaminan sosial ketenagakerjaan oleh BPJS Ketenagakerjaan
yang merupakan wujud implementasi dari ketentuan Pasal 34 ayat (4) UUD Tahun
1945. Sejak terbitnya UU SJSN dan UU BPJS, sekurangnya telah terjadi perubahan
melalui berbagai putusan-putusan Mahkamah Konstitusi dan perubahan Undang-
Undang melalui metode omnibuslaw yakni UU Cipta Kerja UU P2SK.
Rumusan masalah dalam skripsi ini ialah 1) bagaimanakah penyelenggaraan
program jaminan sosial ketenagakerjaan menurut ketentuan peraturan perundang-
undangan, dan 2) bagaimanakah penataan peraturan perundang-undangan jaminan
sosial ketenagakerjaan pada era Society 5.0 sebagai dampak terbitnya UU Cipta
Kerja dan UU P2SK. Penelitian ini ialah penelitian hukum normatif dengan
pendekatan peraturan perundang-undangan dan konseptual.
Dari hasil penelitian ini dapat disimpulkan bahwa penyelenggaraan program
jaminan sosial ketenagakerjaan yang diatur dalam UU SJSN dan UU BPJS
menunjukkan bahwa negara berkomitmen menciptakan dan memajukan
kesejahteraan umum yang diwujudkan dengan penyelenggaraan jaminan sosial
terhadap seluruh warga negara, meskipun masih terdapat kekurangan dalam
implementasinya sebagaimana hasil berbagai kajian dan evaluasi. Untuk kepastian
hukum diperlukan penataan peraturan perundang-undangan jaminan sosial
ketenagakerjaan dapat dilaksanakan dengan 1) Penataan jenis, hirarki dan materi
muatan peraturan perundang-undangan yang terkait amanah dari UU P2SK dan UU
Cipta Kerja terkait program JHT, harmonisasi Program Pensiun, dan pengaturan
cutloss serta penurunan nilai investasi, serta pelaksanaan putusan MK terkait
pengalihan program dan penyelenggaraan program oleh BPJS dan 2) Penataan
substansi peraturan perundang-undangan yang terkait evaluasi usia pensiun,
penyesuaian besaran iuran jaminan pensiun, dan optimalisasi regulasi pelaksanaan
Instruksi Presiden Nomor 2 Tahun 2021. Kata Kunci : Jaminan Sosial, Ketenagakerjaan, Penataan, Peraturan
Perundang-undangan, Omnibuslaw, Society 5.0. / The implementation of employment social security by BPJS Ketenagakerjaan is
a form of implementation of the provisions of Article 34 paragraph (4) of the 1945
Constitution above. Since the issuance of the SJSN Law and the BPJS Law, at least
changes have occurred through various decisions of the Constitutional Court and
changes to the Law through the omnibuslaw method, namely in 2 laws, Job Creation
Law P2SK Law.
The formulation of the problem in this thesis are 1) how is the implementation of
the employment social security program according to statutory provisions, and 2)
how is the arrangement of employment social security legislation in the Society 5.0
era as a result of the issuance of the Job Creation Law and the P2SK Law. This
research is normative legal research with a statutory and conceptual approach.
From the results of this study it can be concluded that the implementation of the
employment social security program regulated in the SJSN Law and the BPJS Law
is the basis for carrying out the mandate of the 1945 Constitution, which shows that
the state is committed to creating and promote the general welfare, state intervention
in the pursuit of public welfare is realized by implementation of social security for
all citizens, although there are still deficiencies in its implementation as per the
results of various studies and evaluations. For legal certainty, it is necessary to
structuring employment social security laws and regulations which can be carried
out by 1) Structuring the types, hierarchy and content material of laws and
regulations related to the mandate of the P2SK Law and the Job Creation Law
related to the JHT program, harmonization of the Pension Program, and cut-loss
arrangements as well reduction in investment value, as well as the implementation
of the Constitutional Court's decision regarding program transfer and program
implementation by BPJS and 2) Structuring the substance of laws and regulations
related to evaluating retirement age, adjusting the amount of pension security
contributions, and optimizing regulations for implementing Presidential Instruction
