Abstract :
Pembunuhan berencana adalah kejahatan menghilangkan nyawa manusia lain, atau membunuh, sebelum melakukan kejahatan dilakukan nya perencanan mengenai waktu, tempat dan metode cara membunuh, dengan memastikan berhasilnya suatu pembunuhan sekaligus memikirkan cara menghindari penangkapan pihak berwajib. Namun bisa menyerah dari sebuah penangkapan sesuai dengan keputusan pelaku kejahatan, membunuh dengan rencana dalam hukum kuhp merupakan tipe pembunuhan yang paling serius dan pelaku bisa diberi hukumana mati ataupun seumur hidup tergantung pertimbangan hakim dalam keputusan pidannya. Pasal dasar yang sengaja menghilangkan nyawa orang lain adalah 338 KUHP yang kemudian bertambah karena unsur perencanaan terlebih dahulu adalah 340 KUHP, dampak yang di timbulkan oleh kejahatan pembunuhan berencana ini adalah hilangnya nyawa korban yang kerugian di timbulkan tidak hanya dirasakan korban namun keluarga korban, perkerjan dan serta masyarakat. Maka wajar jika hukum positif melindung nyawa setiap manusia dari segala upaya pelanggaran oleh orang lain dengan memberikan acaman hukum yang amat berat kepada pelaku kejahatan pembunuhan berencana. Namun disini masih banyak yang harusndi pertimbangkan hakim dalam menjatukan hukuman mati atau pun hukuman seumur hidup karena perlu dikaji sangat dalam dan serius untuk menjatuhkan hukuman berat pada pelaku pembunuhan. / Planned killing is the crime of taking another human's life, or killing it, before committing the crime, planning about the time, place and method of killing, by ensuring the success of a murder while thinking of ways to avoid arresting the authorities. But can surrender from an arrest in accordance with the decision of the perpetrators of crime, murder with a plan in the Kuhp law is the most serious type of murder and the perpetrators can be sentenced to death or for life depending on the judge's judgment in the decision of his speech. The basic article that intentionally eliminates the lives of others is 338 KUHP which then increases because the first element of planning is 340 KUHP, the impact caused by the crime of premeditated murder is the loss of the lives of the victims whose losses are not only felt by the victims but the families of the victims, employment and as well as the community. So naturally if the positive law protects the lives of every human being from all attempts of violation by others by giving a very severe legal threat to the perpetrators of premeditated murder. But here there is still much to be considered by judges in uniting the death penalty or life sentence because it needs to be studied very deeply and seriously to impose severe sentences on the perpetrators of the killings.
