Abstract :
dengan mudahnya berhubungan dengan teman-temannya dimanapun keberadaannya. Efek yang muncul dengan adanya kemajuan teknologi bisa berdampak positif dan negatif, salah satu dampak negatif yang ditimbulkan adalah Perundungan Dunia Maya (cyberbullying). Bentuk cyberbullying adalah ejekan, ancaman, hinaan, ataupun hacking. Fenomena cyberbullying banyak bermunculan dan akibat fatal dari tindakan ini adalah bunuh diri. Berdasarkan hal tersebut maka dapat ditarik beberapa permasalahan yang perlu di kemukakan yakni, bagaimana perlindungan anak korban tindak pidana perundungan dunia maya (cyberbullying) menurut UU No.19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik? dan bagaimana penerapan ketentuan perlindungan anak korban tindak pidana dalam praktek/proses hukum di Indonesia? Untuk menganalisa permasalahan tersebut maka digunakan Teori Perlindungan Anak dan teori Tindak Pidana metodologi yang digunakan sejalan dengan kerangka teoritis yaitu metodologi kualitatif, dengan tipe penelitian deskriptif dan berparadigma fenomenologi. Contoh kasus yang diambil dalam penelitian ini anak angkat dari Ruben Onsu yakni Betrand Peto. Pengumpulan data dengan menggunakan studi pustaka teknik analisis dengan cara transkrip reduksi data, penyajian data, dan kesimpulan. Maka hasil dari penelitian di atas dapat kita temukan bahwa korban cyberbullying dilindungi oleh undang-undang yang telah di atur dalam Undang?Undang No.19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik,Kitab Undang-Undang Hukum Pidana,dan Undang-Undang No.35 Tahun 2014 Tentang Perlindungan Anak, dari analisis kasus diatas maka penerapan hukum yang digunakan yakni pasal 27 ayat (3) jo. 45 ayat (1) Undang-Undang No.19 Tahun 2016. Namun Undang-Undang ini belum di terapkan karena kasus ini masih aduan saja. Dari hasil penelitian ini penulis berharap pengguna media sosial, apa pun itu bentuknya, agar dapat bijak, beretika, dan tidak terpancing oleh akun-akun anonim untuk ikut serta melakukan bullying terhadap pihak-pihak tertentu. Kata Kunci : Perlindungan Hukum, Anak, Korban, Cyberbullying / In this globalization era, the creation of technological advances makes it easy for teenagers to connect with their friends wherever they are. The effects that arise with technological advances can have positive and negative impacts, one of the negative impacts caused is the Cyber Abuse (cyberbullying). Forms of cyberbullying are ridicule, threats, insults, or hacking. The cyberbullying phenomenon has arisen and the fatal result of this action is suicide. Based on this, several issues that need to be raised can be drawn, namely, "how is the protection of child victims of cyberbullying under the Law No.19 of 2016 about Information and Electronic Transactions? and how is the application of the provisions for the protection of child victims of criminal offenses in practice / legal processes in Indonesia? To analyze this problem, the Child Protection Theory and the Crime of Theory method are used in line with the theoretical framework, which is a qualitative method, with a descriptive research type and a phenomenological accepted point of view. The case study example taken in this study is adopted children of Ruben Onsu namely Betrand Peto. Data collection using library research analysis techniques by means of data reduction transcripts, data presentation, and conclusions. The results of the above research can be found that cyberbullying victims are protected by laws that have been regulated in Law No.19 of 2016 about Information and Electronic Transactions, Criminal Law Book, and Law No.35 Year 2014 Concerning Child Protection, from the case analysis above, the application of the law used is article 27 paragraph (3) No. 45 paragraph (1) of Law No. 19 of 2016. However, this Law has not yet been applied because this case is still a complaint.
