Abstract :
This thesis discusses the legal implications of the obligations and responsibilities of
housing developers in the provision of social facilities (fasos) and public facilities
(fasum) to the fulfillment of consumer subsidized housing rights in the Serdam Raya
Residence Complex in Kubu Raya Regency, West Kalimantan Province. Through a
literature study using the empirical legal approach method, it can be concluded that
the causes of housing developers do not fulfill their obligations and responsibilities
in the provision of social facilities (social facilities) and public facilities (fasum)
towards the fulfillment of subsidized housing consumer rights in the Serdam Raya
Residence Complex in Kubu Regency Raya Kalimantan Barat Province is caused by
financial / budgetary constraints in providing social facilities (social facilities) and
public facilities (public health facilities). Whereas financing in the construction of
social facilities (social facilities) and public facilities (public facilities) on housing is
charged to consumers who have been included in house prices. Legal implications
of the obligations and responsibilities of housing developers in the provision of
social facilities (social facilities) and public facilities (fasum) to the fulfillment of
subsidized housing consumer rights in the Serdam Raya Residence Complex in Kubu
Raya Regency, West Kalimantan Province, are consumers who are disadvantaged
by the developer because they do not comply with the promise promises as
contained in the marketing brochure when the developer offers their home. Thus it
can be said that consumers do not get protection even though Law No. 8 of 1999
concerning Consumer Protection has been established. Efforts to fulfill the
consumer rights of subsidized housing Complex Serdam Raya Residence in Kubu
Raya Regency, West Kalimantan Province with the existence of obligations and
responsibilities of housing developers in the provision of social facilities (social
facilities) and public facilities (public health facilities) have actually been done by
consumers by filing complaints in the office of PT. Teja Kusuma Jaya as the
developer, but was never taken seriously and the developer seemed to run away
from his obligations and responsibilities in providing social facilities (social
facilities) and public facilities (public facilities). In fact, consumers of subsidized
housing Complex Serdam Raya Residence in Kubu Raya Regency, West Kalimantan
Province do not know and do not know where to go to file their complaints. In
addition, subsidized housing consumers in the Serdam Raya Residence Complex in
Kubu Raya Regency, West Kalimantan Province also have a fear of spending a sum
of money to file complaints with government agencies because consumers assume
that dealing with government agencies requires large costs.

empiris diperoleh kesimpulan, bahwa faktor penyebab pengembang perumahan tidak
memenuhi kewajiban dan tanggung jawabnya dalam penyediaan fasilitas sosial
(fasos) dan fasilitas umum (fasum) terhadap upaya pemenuhan hak konsumen
perumahan bersubsidi Kompleks Serdam Raya Residence di Kabupaten Kubu Raya
Provinsi Kalimantan Barat disebabkan oleh keterbatasan keuangan/ anggaran dalam
penyediaan fasilitas sosial (fasos) dan fasilitas umum (fasum). Padahal pembiayaan
dalam pembangunan fasilitas sosial (fasos) dan fasilitas umum (fasum) pada
perumahan dibebankan kepada konsumen yang sudah dimasukkan dalam harga
rumah. Implikasi hukum kewajiban dan tanggung jawab pengembang perumahan
dalam penyediaan fasilitas sosial (fasos) dan fasilitas umum (fasum) terhadap upaya
pemenuhan hak konsumen perumahan bersubsidi Kompleks Serdam Raya
Residence di Kabupaten Kubu Raya Provinsi Kalimantan Barat adalah konsumen
dirugikan oleh pihak pengembang karena tidak sesuai dengan janji-janji
sebagaimana dimuat dalam brosur pemasaran pada saat pengembang menawarkan
rumah mereka. Dengan demikian dapat dikatakan bahwa konsumen tidak
mendapatkan perlindungan walaupun telah ada Undang-Undang Nomor 8 Tahun
1999 tentang Perlindungan Konsumen. Upaya pemenuhan hak konsumen
perumahan bersubsidi Kompleks Serdam Raya Residence di Kabupaten Kubu Raya
Provinsi Kalimantan Barat dengan adanya kewajiban dan tanggung jawab
pengembang perumahan dalam penyediaan fasilitas sosial (fasos) dan fasilitas
