Abstract :
Penelitian ini menganalisis tentang Proses Impeachment Presiden Dan/Atau Wakil Presiden Dalam Ketatanegaraan Indonesia (Studi Perbandingan Dengan Negara Amerika Serikat). Sebagai tujuan untuk mengetahui perbandingan pemberhentian Presiden di Indonesia dan Amerika Serikat. Berdasarkan data yang digunakan penelitian ini, maka sumber datanya terdiri dari data primer dan data sekunder. Dari sumber data primer dalam penelitian yaitu UUD 1945 dan Konstitusi Amerika Serikat. Dan data sekunder dalam penelitian ini yaitu buku-buku yang berkaitan dengan penelitian. Hasil penelitian yang diperoleh adapun lembaga-lembaga yang terlibat dalam proses pemberhentian Presiden dan Wakil Presiden di Indonesia setelah perubahan UUD Tahun yaitu DPR, MK dan MPR. Sedangkan, di Amerika Serikat lembaga yg terlibat dalam proses pemberhentian Presiden dan Wakil presiden beserta menteri-menteri nya yaitu Senate dan House Of Representatives. Pemberhentian presiden dalam masa Jabatan di indonesia dapat diterapkan kepada seorang presiden apabila presiden terbukti melanggar Pasal 7A UUD, sedangkan di Amerika Serikat Presiden diberhentikan jika terbukti melakukan pelanggaran terhadap Article II Section 4. Kata Kunci : Pemberhentian Presiden, Impeachment,Pemakzulan Presiden, Perbandingan Impeachment / This study analyzes the Impeachment Process of the President and / or Vice President in the Indonesian Constitution (Comparative Study with the United States of America). As an aim to compare the dismissal of the President in Indonesia and the United States. Based on the data used in this study, the data sources consist of primary data and secondary data. From the primary data sources in the study, namely the 1945 Constitution and the United States Constitution. And secondary data in this study are books related to research. The results of the research obtained are that of the institutions involved in the process of dismissing the President and Vice President in Indonesia after the amendment of the Year Constitution, namely the DPR, the Constitutional Court and the MPR. Meanwhile, in the United States the institutions involved in the dismissal of the President and Vice President and their ministers are the Senate and the House of Representatives. The dismissal of the president during his term of office in Indonesia can be applied to a president if the president is proven to have violated Article 7A of the Constitution, while in the United States the President is dismissed if he is proven to have violated Article II Section 4.
