Abstract :
The outsourcing system is the delegation of daily operations and management of a business process to an outside party (outsourcing service provider company). Through delegation, the management is no longer carried out by the mining business license holder (company) but is delegated to an outsourcing service company. Protection of workers is intended to guarantee the basic rights of workers and ensure equal opportunity and treatment without discrimination of anything to realize the welfare of workers and their families while taking into account the progress of the business world and the interests of entrepreneurs. Many government regulations discuss the outsourcing system, but they are considered to have not solved the problem because workers still feel that the outsourcing system does not really defend the workers, which is actually beneficial for the company. However, due to the difficulty of the work available for the workforce, the workers finally accepted the outsourcing work system created by the company.
The research method used in this research is normative juridical research. Sources of data come from primary data and secondary data collected through library research, companies holding business licenses and outsourcing service providers.
The results of this study conclude that the workers who become outsourced workers in mineral and coal mining business management activities are very valuable assets, which are owned by mining business license holders. To be able to produce good mining products, mining business license holders must provide comfort for their workers through protection. Protection provided by the company such as social protection or health protection; technical protection or work safety protection; and economic protection or social security.
