Abstract :
Penelitian ini bertujuan untuk meninjau pemenuhan kewajiban konsumen jasa layanan internet IndiHome selama masa Pandemi Covid-19 dengan tinjauan menurut Undang-Undang RI Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen. Penelitian ini menggunakan acuan akan teori konsumen, teori perilaku konsumen,teori kepastian hukum dalam perlindungan konsumen serta kajian mengenai perjanjian dalam kontrak berlanganan IndiHome. Hasil penelitian menunjukkan bahwa, dalam kontrak berlamgganan IndiHome jasa layanan internet IndiHome termasuk dalam perjanjian baku, karena telah memenuhi ciri-ciri perjanjian baku secara teoritis telah memenuhi ketentuan Pasal 1320 KUHPerdata mengenai syarat sahnya suatu perjanjian. Penelitian ini juga menunjukkan akan faktor pendukung, penghambat yang oleh pelanggan IndiHome dalam memenuhi kewajibannya. Peneliti memberikan strategi upaya dalam meningkatkan agar antara kewajiban dan hak antar pelaku usaha dan pelanggan IndiHome di dalam peningkatan kualitas layanan serta saran hadinya Standard Operating Procedure dari pihak pelaku usaha. Penelitian ini akan lebih baik dengan hadirnya studi lanjutan yang melibatkan pihak manajemen IndiHome untuk memberikan data terkait upaya lanjutan dari sisi pelaku usaha dalam pemenuhan kewajiban pelanggan IndiHome selama masa Pandemi Covid-19. // This study aims to review the fulfillment of the obligations of consumers of Internet services IndiHome during the Covid-19 Pandemic by enacting the Republic of Indonesia Law Number 8 of 1999 concerning Consumer Protection. This study uses references to consumer theory, consumer behavior theory, legal certainty theory in consumer protection, and studies of agreements in IndiHome subscription contracts. The results show that, in the IndiHome subscription contract, the IndiHome internet service is included in the standard agreement, because it has fulfilled the standard agreement requirements, theoretically, it has fulfilled the provisions of Article 1320 of the Civil Code regarding the legal requirements of an agreement. This research also shows the supporting factors, obstacles that IndiHome customers can fulfill in fulfilling their obligations. Researcher on the strategy of efforts to improve the obligations and rights between business actors and IndiHome customers in improving the quality of services and suggestions for having Standard Operating Procedures from the business actors. This research will be better by presenting a follow-up study involving the management of IndiHome to provide data regarding further efforts from the side of business actors in fulfilling the obligations of IndiHome customers during the Covid-19 pandemic.
