DIKAITKAN DENGAN KEPASTIAN PERLINDUNGAN HUKUM
KONSUMEN (STUDI PADA RUMAH SUSUN DKI JAKARTA).
Pasal 28 UU Nomor 20 Tahun 2011 tentang Rusun mengatur pembangunan
rusun dapat dilakukan setelah pelaku pembangunan (developer) memenuhi syarat
status hak atas kepemilikan tanah dan IMB. Dalam prakteknya, pembangunan
rusun di DKI Jakarta dapat dilakukan sebelum memiliki IMB, sesuai dengan
aturan dalam Keputusan Gubernur DKI Jakarta Nomor 76 Tahun 2000 tentang
Tata Cara Memperoleh IPB dan Kelayakan Menggunakan Bangunan Di Provinsi
DKI Jakarta, sehingga pada prakteknya banyak terjadi pelanggaran persyaratan
teknis rusun misalnya persyaratan Koefisien Lantai Bangunan, Koefisien Dasar
Bangunan, pelanggaran persyaratan teknis ini menyebabkan proses penerbitan
menjadi terkendala. Penelitian ini bertujuan untuk mengetahui sinkronisasi UU
Rusun dikaitkan dengan kepastian perlindungan hukum konsumen. Metode
penelitian menggunakan Pendekatan Perundang-Undangan. Penelitian Pendekatan
Perundang-Undangan menggunakan jenis eksplanatori, unit sampel berupa
sebagian masyarakat DKI Jakarta yang pernah membeli apartment di DKI Jakarta,
dengan populasi sebanyak N=3984 konsumen. Pengambilan sampel menggunakan
metode probability sampling, besar sampel dihitung dengan rumus Slovin, di
peroleh sampel n=170. Instrumen penelitian berupa kuesioner, menggunakan
Skala Likert, dengan 5 butir respon. Evaluasi kuesioner dilakukan dengan 3
tahapan yaitu Pra Test, Expert Test dan Pilot Test serta uji validitas dan
reliabilitas konstruk, dan diperoleh bahwa kuesioner valid dan reliabel. Analisis
data dilakukan secara deskriptif dan inferensial menggunakan analisis WarpPLS
(Partial Least Square). Hasil penelitian menunjukkan bahwa: (1) Sinkronisasi UU
Rusun berpengaruh signifikan positif terhadap Perilaku Developer. (2)
Sinkronisasi UU Rusun berpengaruh signifikan positif terhadap Perlindungan
Konsumen. (3) Perilaku Developer berpengaruh signifikan positif terhadap
Perlindungan Konsumen.

Article 28 of the Flat Law regulates that the construction of a flat can be
carried out after the developer (developer) meets the requirements for the status of
land ownership rights and building construction permits. In practice, the
construction of flat in DKI Jakarta can be carried out before having an according
to the rules in the Governor of DKI Jakarta Decree Number 76 of 2000
concerning Procedures for Obtaining, IPB and the Feasibility of Using Buildings
in DKI Jakarta Province, so that in practice there are many violations of technical
requirements. rusun, for example, the requirements for the Building Floor
Coefficient, the Basic Building Coefficient, violations of these technical
requirements caused the issuance process to be hampered. This study aims to
determine the synchronization of Law Number 20 Year 2011 concerning Flat with
the certainty of consumer legal protection. The research method used normative
juridical and empirical juridical. This juridical empirical research uses explanatory
type, the sample unit is some of the people of DKI Jakarta who have bought
apartments in DKI Jakarta, with a population of N = 3,984 consumers. Sampling
using probability sampling method, the sample size is calculated by the Slovin
formula, obtained a sample of n = 170. The research instrument was a
questionnaire, using a Likert scale, with 5 response items. The evaluation of the
questionnaire was carried out in 3 stages, namely the pre-test, the expert test and
the pilot test, as well as the construct validity and reliability, and it was found that
the questionnaire was valid and reliable. Data analysis was carried out
descriptively and inferentially using the WarpPLS (Partial Least Square) analysis.
The results showed that: (1) Synchronization of Law no. 20 of 2011 has a
significant positive effect on Developer Behavior. (2) Synchronization of Law no.
20 of 2011 has a significant positive effect on Consumer Protection. (3)
Developer behavior has a significant positive effect on Consumer Protection.
