Abstract :
Penelitian ini bertujuan untuk meingeitahuii dan menganalisis pelaksanaan perjanjian kerja sama program shoppe affiliate dengan content creator dan meingeitahuii dan menganalisis permasalahan yang timbul dalam proses perjanjian kerja sama shopee affiliate dengan content creator. Metode penelitian yang digunakan dalam skripsi ini dilakukan dengan pendekatan yuridis empiris dengan mengumpulkan data dari narasumber penelitian untuk melakukan pendekatan dan wawancara. Hasil penelitian ini menyatakan peirjanjian antara pihak Shopeiei deingan affiliatei dalam Program Shopeiei Affiliatei meiruipakan beintuik peirjanjian keirjasama keimitraan yang dilakuikan seicara bakui. Dan peirjanjian dalam Program Shopeiei Affiliatei meiruipakan peirjanjian yang sah kareina teilah meimeinuihi syarat sahnya peirjanjian dalam Pasal 1320 KUiH Peirdata seilagi calon affiliatei dinyatakan teilah cakap huikuim. Permasalahan yang timbul dalam proses perjanjian kerja sama shopee affiliate dengan content creator adanya perjanjian yang bersifat baku ini tidak ada timbal balik antara kedua belah pihak karena perjanjian kerjasama kemitraan ini telah ditentukan oleh salah satu pihak selain itu terkait keterlambatan pembayaran komisi oleh karena itu dibutuhkan perlindungan hukum terhadap masyarakat agar dapat menikmati semua hak-hak yang diberikan oleh hukum. This study aims to identify and analyze the implementation of the Shopee Affiliate program cooperation agreement with content creators and to analyze the problems that arise in the process of the Shopee Affiliate cooperation agreement with content creators. The research method used in this thesis was carried out using an empirical juridical approach by collecting data from research informants by conducting approaches and interviews. The results of this study state that the agreement between Shopee and affiliates in the Shopee affiliate program is a standard form of partnership cooperation agreement. And the agreement in the Shopee affiliate program is a valid agreement because it fulfills the legal requirements of the agreement in Article 1320 of the Civil Code, while the prospective affiliate is declared legally competent. The problem that arises in the process of the shopee affiliate cooperation agreement with content creators is that there is a standard agreement that there is no reciprocity between the two parties because this cooperation agreement has been determined by one of the parties besides that it is related to late payment of commissions, therefore community legal protection is needed so that may enjoy all the rights granted by law.
