Abstract :
The aim of this research is to determine and analyze the existence of hakam in syiqaq cases in the Class 1A Religious Courts of Jambi City and the factors that influence the existence of hakam in the Class 1A Religious Courts of Jambi City. The method used in this thesis is Empirical Juridical Research. As a result of the research carried out, the author found the conclusion that in practice in the Class 1A Religious Court of Jambi City, it is difficult to differentiate how cases fall into the category of syiqaq and ordinary disputes and there are many factors that influence the existence of judges in syiqaq cases in the Class 1A Religious Court of Jambi City, one of which is The Class 1A Religious Court of Jambi City held a general hearing regarding the divorce case for syiqaq reasons with the reasons for divorce hulrulf F Perratulran Permelintah No. 9 of 1975 concerning the Implementation of Undang-Undang Number 1 of 1974 concerning Marriage and Legal Protections involving the rights and syi This qaq is still ulmulm, bellulm is explained in Undang-Undang or other instrulmelnt regulations regarding the requirements of the Hakam and the procedures for appointing the Hakam in resolving the shiqaq case itself.
