Abstract :
Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisis perlindungan pekerja pada yayasan pendidikan swasta dilihat dari aspek ekonomi serta untuk mengetahui dan menganalisis kendala yang dihadapi yayasan pendidikan dalam menyesuaikan standar upah para pekerjanya. Adapun rumusan masalah dalam penelitian ini yaitu: 1) Bagaimana perlindungan pekerja di Yayasan Islam Al Hidayah ditinjau dari aspek ekonomi? 2) Apa saja kendala yang dihadapi yayasan pendidikan dalam menyesuaikan standar upah para pekerjanya?. Metode penelitian yang digunakan yakni yuridis empiris. Berdasarkan hasil penelitian, perlindungan pekerja di Yayasan Islam Al Hidayah dalam aspek ekonomi belum dapat terpenuhi sesuai dengan peraturan perundang-undangan. Adapun yang menjadi kendala yayasan dalam menyesuaikan standar gaji para pekerja nya, yaitu: (1) Yayasan Islam Al Hidayah yang merupakan badan hukum sosial, sumber pemasukan keuangan yayasan yang berasal dari Sumbangan Pembinaan Pendidikan (SPP) siswa yang tergolong rendah dari rata-rata sekolah lain sehingga belum sanggup digunakan untuk menaikkan gaji para pekerja nya (2) Sumber pemasukan sekolah dari dana Bantuan Operasional Siswa (BOS) dan Sumbangan Pembinaan Pendidikan (SPP) tidak sesuai dengan besarnya kebutuhan sekolah membuat yayasan kesulitan dalam menggaji para pekerjanya. Belum lagi, dikarenakan saat ini sedang adanya pembangan gedung baru MI/SD sehingga pihak yayasan fokus untuk menyelesaikan pembangunan terlebih dahulu. Kata kunci: perlindungan, pekerja, aspek ekonomi, jaminan sosial. The aim of this research is to find out and analyze worker protection at private educational foundations from economic aspects as well as to find out and analyze the obstacles faced by educational foundations in adjusting the salary standards for their workers. The problem formulation in this research is: 1) How are workers protected at the Al Hidayah Islamic Foundation in terms of economic? 2) What are the obstacles faced by educational foundations in adjusting the salary standards for their workers? The research method used is empirical juridical. Based on the research results, worker protection at the Al Hidayah Islamic Foundation in economic aspects has not been fulfilled in accordance with statutory regulations. The obstacles to the foundation in adjusting the salary standards for its workers are: (1) The Al Hidayah Islamic Foundation, which is a social legal entity, the source of the foundation's financial income comes from students' Educational Development Contributions (SPP) which is relatively low compared to the school average. other things so that it cannot be used to increase the salaries of its workers (2) The source of school income from Student Operational Assistance (BOS) funds and Educational Development Contributions (SPP) does not match the size of the school's needs, making it difficult for foundations to pay their workers. Not to mention, because currently there is construction of a new MI/SD building so the foundation is focused on completing the construction first.
