Abstract :
One thing that cannot be denied has happened and will continue to happen is
the development of the times. The development of the era also includes aspects of
technological development. The rapid development of technology makes it difficult for
lawmakers to create a law that can accommodate problems related to the technology
itself. One example is electronic trading transactions carried out through e-commerce,
such as Tokopedia. The difficulty of creating laws that can accommodate all aspects
given how advanced the technological development is, the more difficult it is for law
enforcers to supervise the electronic transactions. One of the biggest problems with this
electronic transaction is the Standard Clause which is conducted unilaterally by the
seller. Although in general, standard clauses are regulated in Law Number 8 of 1999
concerning Consumer Protection, but the difficulty of enforcing and overseeing the
large number of sellers in the marketplace does not manifest well these regulations. In
that case the authors conducted a study related to the legal force of the agreement in
the e-commerce transaction in Tokopedia against the Civil Code, as well as the standard
clause stipulated in Law Number 8 of 1999 concerning Consumer Protection.
