Abstract :
Rapid technological advances shows direct impact on the demands on the speed of information flow. Internet-based social media like Youtube are the mainstay of the public to get information and entertainment, especially entertainment in the form of music. This is well utilized by musicians to promote works, both their own works and adaptations of musical works that have existed before. Lack of awareness of the protection of copyright as stipulated in Law Number 28 of 2014 about copyrights creates a loophole for various violations of copyrights. In the thesis, the author uses a type of normative juridical research based on the current legal regulations related to intellectual property rights. The data were collected from library studies, and the author used normative analysis techniques in order to interpret and study the matter based on definitions, theories, and doctrines related to the subject. The following thesis takes on the difference of rights between creator or copyright owner and cover version uploader on the Youtube channel. Youtube provided a system in order to minimize the spread of plagiarism and copyright violations. The system called Content ID would then gave the options for the creator or copyright owner to either take economic advantages from the cover cersion videos or to prohibit the video to be seen by viewers. The author believes that the Content ID system does not provide an option for the cover version video uploader to explain various creative contributions added to the music's copyrighted work. This is considering that even in the production process of an adaptation copyrighted work there are various sacrifices in order to produce the adaptation work. Although the system does provide protections on both economic and moral rights for the creator or copyright owner, Content ID system should ideally be able to facilitate the ability to upload cover version videos to be able to discuss various considerations for the creator or copyright owner.
