Abstract :
Special Capital Region of Jakarta (DKI Jakarta) as the capital city of the Republic of Indonesia is a special region that is authorized to carry out administration of reclamation in the Jakarta?s North Coast based on Presidential Decree No. 52 of 1995 on the North Coast Jakarta Reclamation and pursuant to Presidential Regulation No. 54 Year 2008 on Spatial Planning Region of Jakarta, Bogor, Depok, Tangerang, Bekasi, Puncak, Cianjur, DKI Jakarta is included in the area of National Strategic Importance. However, since the issuance of Presidential Regulation No. 122 of 2012 on Reclamation in Coastal Areas and Small Islands which states that reclamation permit in areas of national strategic importance is the authority of the Minister of Maritime Affairs and Fisheries. This makes overlapping authority of granting reclamation permit of Jakarta?s North Coast between Jakarta Provincial Government and the Ministry of Maritime Affairs and Fisheries. To provide legal certainty for all parties, the Government should establish a national regulation as a legal basis for reclamation in Indonesia in order to prevent conflicts in granting reclamation permits in Indonesia.
