Abstract :
Indonesia is a state of law, therefore it should be a diverse the function of the division of power into three branches: executives, legislative, and judicicary. Indepedency of judicial power is one of the main characteristics of a state of law, so that the independence must be maintained properly. In maintaining the independence of judicial power, it requires an external oversight body that functions to supervise. This external oversight body is known as Komisi Yudisial. In carrying out its duties and functions, Komisi Yudisial requires members with a high competence. Therefore, in the selection of members required selection mechanism that has a high standard. Researcher have chosen 2 countries such as France and Netherlands that will be used as comparative study in filling positions of judicial commission. Normative research will be used statutes and comparative approach. From this thesis, it was found that each country has its own way of determining and appointing the members of judicial commission. France uses the unified nomination system and the Netherlands uses a mixed mechanism.
