Abstract :
The mode of transportation in the form of Commuter line is a transportation that is often used by people in Jakarta, including Disabled People, in carrying out various activities. The fulfillment of the rights for persons with disabilities in fact still often becomes a problem due to the non-maximization of the fulfillment ofthe rights for persons with disabilities in using the commuter line. Based on these problems,research conducted using empirical-normative legal research aims to examine the legal protection of the rights of persons with disabilities and the fulfillment of elements of tort against violations of the rights of persons with disabilities in using the commuter line. The approach used in this research is a descriptive analysis approach with data collection techniques used, namely interviews and questionnaires, and then the data obtained were analyzed using qualitative data analysis methods. The results of this research discussion indicate that the legal protection of the fulfillment of the rights of persons with disabilities has been carried out by issuing various regulations both from the Law to the Minister of Transportation. However, in fact, the rights of people with disabilities in using the commuter line are often ignored. Violations of the rights of persons with disabilities in using computer line can be concluded that they have fulfilled elements of tort, namely the existence of tort by not fulfilling various facilities stipulated in the legislation, so there is no justification for the violation up to the fulfillment of the element of loss obtained by persons with disabilities due to violations of the rights of persons with disabilities in using commuter line.
