Abstract :
Traffic accidents are a phenomenon that often occurs, especially in cities and towns. Starting from minor accidents that do not cause casualties to heavy traffic accidents that cause casualties. The high number of traffic accidents every year also increases. Because more and more users of motorcycles and cars by the community. One of the reasons why motorbike and car users crash due to damaged roads is because the road was not repaired immediately and no sign is provided to supervise not cross the road. Traffic accidents due to damaged roads occur because the damaged roads are not repaired . The person responsible for the accident happened due to the damaged road is the organizer of the road. Road operators must maintain security, safety, order and smooth traffic and road transportation. The authority of the road operator rests with the Government and Regional Governments. Traffic accidents due to damaged roads are due to illegal acts by the government and local governments. This study aims to determine the responsibility and compensation for experiencing traffic accidents due to damaged roads that is not immediately repaired and given no sign. This research examines the approach of traffic accidents due to damaged roads or landslides that occur in the city of Pematang Siantar. The case suffered loss and loss of life. Therefore conduct research on the liability and compensation in road traffic accidents. This research was written using normative legal research and qualitative data.
