Abstract :
ABSTRAKRencana Pembangunan Jangka Menengah Nasional (RPJMN) 2020-2024 di bidang kesehatan salah satunya adalah penurunan persentase merokok usia 0-18 tahun dari 9,1 menjadi 8,7 pada 2024. Dari data Dinas Kesehatan Provinsi Sumatera Utara pada tahun 2022 di kota Medan sebanyak 25,32 penduduk Medan yang berusia ?15 tahun merokok. Penerapan kawasan tanpa rokok adalah upaya untuk menurunkan jumlah perokok dan menghindarkan masyarakat luas dari bahaya asap rokok. Penerapan Kawasan Tanpa Rokok di Kota Medan dituangkan dalam Peraturan Daerah Kota Medan Nomor 3 Tahun 2014 tentang Kawasan Tanpa Rokok. Tujuan dari Penelitian ini adalah menganalisa secara yuridis normatif bagaimana pengaturan dan penerapan sanksi pada pelanggaran Kawasan Tanpa Rokok (KTR) di Kota Medan. Metode penelitian studi normatif menggunakan pendekatan statuta dan pendekatan konseptual serta melihat kenyataan yang terjadi dari penelitian terdahulu. Hasil penelitian bahwa pengaturan sanksi pada pelanggaran terhadap Kawasan Tanpa Rokok (KTR) di Kota Medan telah sesuai dengan tujuan hukum Teori jenjang norma hukum. Namun penerapan sanksi KTR di Kota Medan memiliki hambatan dalam 4 faktor, yaitu: faktor komunikasi, faktor disposisi dan faktor birokrasi. Sehingga peneliti memberikan saran agar dilakukan penelitian mendalam terkait respon masyarakat terhadap penerapan sanksi Kawasan Tanpa Rokok di Kota Medan.Kata kunci: kebijakan publik, kawasan tanpa rokok (ktr), merokokABSTRACTOne of the 2020-2024 National Medium-Term Development Plans (RPJMN) in the health sector is reducing the percentage of smoking aged 0-18 years from 9.1 to 8.7 in 2024. The implementation of smoke-free areas is an effort to reduce the number of smokers and prevent the wider community from the dangers of cigarette smoke. The implementation of Smoke Free Areas in Medan City is set forth in Medan City Regional Regulation Number 3 of 2014 concerning Smoke Free Areas. The purpose of this study is to analyze normatively juridically how to regulate and apply sanctions for violations of Non-Smoking Areas (KTR) in Medan City. The normative study research method uses a statute approach and a conceptual approach and looks at the facts that occur from previous research. The results of the study show that the regulation of sanctions for violations of Non-Smoking Areas (KTR) in Medan City is in accordance with the legal objectives of the theory of legal norms levels. However, the application of KTR sanctions in Medan City has obstacles in 4 factors, namely: communication factors, disposition factors and bureaucratic factors. So the researchers suggest that in-depth research be carried out regarding the community's response to the application of sanctions in the No-Smoking Area in Medan City.Keywords: public policy, non-smoking area, smoking
