Abstract :
PatientsascitizensoftheIndonesiancommunityhavetherightto live properly according to Article 28 H paragraph (1) ofthe 1945Constitution.Thefourthamendmentstatesthat:"Everyonehastherighttoliveinpeaceandprosperity,tolive,andtohaveagoodandhealthylivingenvironment.andhastherighttoreceivehealthservices."ThemandateinthefourthparagraphofthePreambleofthe1945Constitutionisthebasisoflegalprotectionforthecommunity,becausetheword"protect"containstheprincipleoflegalprotectionforallofIndonesiatoachievejustice.Inaddition,thePreambleofthefourthAleniaofthe 1945 Constitution also contains the main idea of Pancasila, wherebythefairandprosperouscanbeimplementedinthe5th(five) preceptsofPancasila,namelysocialjusticeforallIndonesianpeopleand alsothedynamicsofcultureregardingindividual,communityinterestsand country.Doctorsasprofessionalsareresponsibleforeverymedicalaction
performedonpatients.Incarryingouttheirprofessionalduties,itisbasedongoodintentionsthatisworkingseriouslybasedontheirknowledge
whichisbasedonadoctor'soath,medicalcodeofethicsandprofessional
standardsforhealing/helpingpatients.
ThefourthAleniaofthe1945Constitutionalsoexplainstheword
"manifest",wherethewordembodiesmeaningtoachievelegalcertaintyin
socialandstatelife,whichissupportedinJeremyBentham'stheory
(Utility)asasupporterofusabilitytheorywhichexplainscertaintyasa
legalobjectivebasicallyistoprovidewelfareforthecommunity"TheGreat
Happinessforthegreatsnumber".Basedonthistheory,theIndonesian
StatemustprotecteveryIndonesiancitizensothatalllegaleventsthat
occurinIndonesiaareinaccordancewiththelawsandregulationssothathereisnolegalvacuum andlegalcertainty
